Hire Contract Terms & Conditions

Definitions


"Craze Central Ltd"
 is a limited company registered at Companies House in England & Wales under registration no. 15558973.

CCL 
is a short-term used for Craze Central Ltd.

We
 or Us refers to Craze Central Ltd.

Client or Customer refers to you, the person placing the order for the hire of goods.

Start time is the beginning of the hire period.

End time is the end of the hire period.

Booking Deposit is the initial and non-refundable amount paid against the total value of your hire order at the time you place it.

Final Balance is the amount outstanding on an order, due by a specified date, after the booking deposit has been paid.

Hired Goods includes video/photo booths, structures and all connecting equipment or cabling, cameras, computers, mobile telephones, props, accessories, lighting, tables, signage, covers, canopies, batteries, and any other materials brought to the venue by CCL.

Venue is the location at which the hired items will be set up and operating for the duration of the hire period.

Host(s) refers to the staff/representatives of CCL that are present during the hire period.

Hirer refers to the person whose name is given on the original order.

Hirer's Proxy refers to any invididual that the hirer has delegated responsibility to at the venue in their absence.

Guests refers to those present at the venue that use the hired equipment.

 

Terms & Conditions

1. Hired goods ownership

1.1 Hired goods are the property of CCL and remain so for the duration of your hire contract.

1.2 Hired goods, as property of CCL, are protected under UK law by all laws applying to theft, vandalism, deliberate or accidental damage.

2. Guest safety, behaviour responsibility and liability

2.1 The safety of guests that use the hired goods is your responsibility.  CCL accept no responsibility or liability for injuries caused to your guests as a result of:

(a) Disobeying instructions given to them by the CCL host(s)

(b) Slipping on any liquids or foods spilled in any area of the venue or hire area

(c) Tripping on marked cables or other trip-hazards where our hosts have pointed out to the Hirer or Hirer's Proxy that guests should be made aware of such hazards or where those trip-hazards are not the property of CCL.

(d) Any collapse, injury, death or illness when using the hired products as a result of pre-existing conditions or non-diagnosed condition such as heart condition, epilepsy, seizure of any type, loss of vision of other health issue.

2.2 Guests must obey and abide by the instructions given to them by CCL signage and CCL host(s) at all times when entering into the hire equipment area, whilst in the hire equipment area and exiting the hire equipment area.

2.3 The hirer or hirer's proxy accepts full responsibility for the behaviour of guests.

2.4 Guests that do not obey and abide by the instructions of the CCL hosts will not be permitted to use hired equipment or enter into the hired equipment area.

2.5 Guests that are, in the opinion of the CCL host(s), intoxicated or unfit will not be permitted to enter or use the hired equipment.

2.6 Any unauthorised physical contact with the CCL host(s) by guests, the hirer, hirer's proxy or third-party is not permitted.

2.7 The hirers, hirer's proxy, guests or third-parties present are not permitted to interfere with the hired equipment in any way, including touching the camera, computer or mobile phone equipment, any supporting structures, batteries, cables or other items owned by CCL.

2.8  CCL hosts are authorised to terminate a hire period at any time, should they believe any of the following conditions apply:

(a) guests, the hirer or the hirer's proxy are demonstrating abusive or intimidating behaviour to them.

(b) any third-party present, that is not a guest, is demonstrating abusive or intimidating behaviour to them and that, after communicating their dissatisfaction to the hirer or hirer's proxy, the behaviour does not cease with immediate effect.

(c) for any reasons, their physical or mental health is compromised by the hirer, hirer's proxy, guests or other third-party present.

(d) the safety of guests, the hirer or the hirer's proxy is compromised by venue conditions or the hirer, hirer's proxy or guest/third-party behaviour.

(e) the hired equipment is under threat of damage or has sustained damage by a guest, hirer, hirer's proxy or third-party.

(f) the provision of power/WiFi is unstable or insufficient to ensure the quality of delivery of service.

(g) they are contacted by other personnel of CCL advising them to cease the event for reasons of non-payment or other information that may have come to light that gives cause for CCL to immediately terminate the event in the interests of our staff, financial security, guests, hirer, hirer's proxy or venue.

(h) adverse or extreme weather conditions may prevent their safe return from the venue (for termination under these conditions they must have sought the prior approval of a Director or senior executive of CCL).

(i) the hired equipment could compromise the safety of guests, the hirer or hirer's proxy

(j) the hired equipment is not performing to a satisfactory standard

(k) where minors are present, parental supervision is not adequate or meeting the requirements set-out by this hire contract.

(l) one or more CCL host suffers illness or injury that affects their ability to manage the hired equipment and the continued delivery of the hired service cannot be adequately performed by any remaining host(s).

(m) any other reasons not listed after communication with a CCL company Director or senior executive.

3. Venue requirements

3.1 The venue must be capable of providing a clean and level floor surface area of at least 10 ft x 10 ft (3.04m cm x 3.04m) with 8 ft (2.44m) of floor to ceiling clearance.

3.2 The venue must be able to provide:

(a) at least 1, preferably 2, 240v UK mains power supply outlets of sufficient stability to power the hired equipment.

(b) WiFi internet access with a download speed of at least 15 mbps and an upload speed of at least 5 mbps.  Please check your venue WiFi is capable of meeting these requirements at https://www.speedtest.net/

(c) a safe environment within which CCL host(s) can deliver our service.

3.3 If the venue charges for parking, or parking charges will be incurred because of a lack of on-site parking availability, the hirer must inform CCL at least 30 days in advance of the hire period.

3.4 If the venue is on any floor above ground floor level where lift/elevator access is not available, the hirer must inform CCL at least 30 days in advance of the hire period.

3.5 The venue must provide the CCL host(s) access to the floorspace on which the hired equipment will be situated at least 60 minutes prior to the start of the hire period.

3.6 The hirer accepts that in the event that any of the aforementioned conditions 3.0 to 3.5 (and sub-points) cannot be met that CCL will cancel the hire period and no refund will be paid, due or claimable.

3.7 Hired goods will only be set-up for use at the venue given on the order.  CCL will not move the location of the venue for delivery/hosting of the hired goods without 30 days notice in writing (by email) from the hirer and a request to move the location.  CCL will reply to the hirer and advise whether their requested venue change is acceptable but are under no obligation to meet the hirer request.  If the hirer wishes to cancel the order if CCL are unable to accept the request, the hirer accepts that our 6.0 Cancellation by the hirer clause and sub-clauses will apply.

4. Hirer damage and theft liability

4.1 In the event that the hired goods sustain damage by a guest, the hirer or hirer's proxy, the hirer accepts entire responsibility for the cost of repairs or replacement.

4.2 In the event that the hired goods sustain damage due to the venue condition, supply of power or other items under the control of the venue, the hirer accepts entire responsibility for the cost of repairs or replacement.  CCL will not pursue the venue, if it is a third-party entity, as it is the responsibility of the hirer to ensure that the venue is fit for purpose and can provide a safe environment for the use of hired equipment.

4.3 CCL will hold the hirer responsible for any losses incurred in respect of missing/stolen items such as props, accessories, electrical items or any other materials that were brought to the venue by the CCL host(s).

4.4 CCL accept that props/accessories, limited to those worn or used by guests in the provision of the 360 video booth experience, are subject to wear and tear.  CCL will not charge the hirer for wear and tear to these items unless they become unfit for re-use due to guests not abiding by the instructions and guidance given by the CCL host(s).

4.5 CCL will notify the hirer of any damage liability within 48 hours of the hire period.

4.6 CCL's assessment of the cost of repair/replacement under the hirer's damage liability is final and we will not enter into negotiation.

4.7 Any monies due to CCL from the hirer's damage liability will be invoiced to the hirer and are due payable within 30 days.  

5. Order Confirmation, Deposit and Balance Due

5.1 The hirer accepts that CCL reserves the right to refuse any order received without giving reason for refusal.  

5.2 If CCL refuses an order, we will write to the hirer by email within 48 hours of the date of order receipt and issue a full refund of any monies paid by the hirer (be it a booking deposit or the full amount of hire price, whichever it is that they have paid).

5.3 The hirer accepts that CCL will not pay any compensation for the refusal of an order.

5.4 The hirer accepts that they must pay a booking deposit of 25% upon placement of the hire order if the hire period start date is more than 30 days from the date on which they place their order.

5.5  The hirer accepts that the full balance of the hire price will be due if they place an order for a hire period where the start date is within 30 days of the date of order placement.

5.6  The hirer accepts that, where a booking deposit has been paid and the hire start date is more than 30 days from the date of the order placement, the balance of the order total is due 30 days from the date of the hire start date.

5.7  The hirer accepts that if the balance due for a hire period has not been paid by 20 days prior to the start of the hire period that CCL will cancel the order and the balance of the order is still due.

5.8  Invoices for balances due will be sent to the hirer by email or will be collected automatically from the debit/credit card used to place the deposit. If an invoice is sent to the hirer it must be paid online through CCL's payment provider/website unless otherwise agreed in writing prior to the final due date.

6. Cancellation by the hirer

6.1  If the hirer wishes to cancel the hire period, they must contact CCL in writing by email at hello@crazecentral.co.uk with the Subject Heading "Cancellation" followed by the order number within 14 days of the date the booking deposit was paid.

6.2 Beyond the 14 day period stated in 6.1 above, and a period greater than 30 days prior to the hired period start date, the hirer accepts that cancellation of the hire period will result in the loss of their non-refundable deposit.

6.3 Beyond the 14 day period stated in 6.1 above, and within 30 days of the start date of the hire period, the full balance of the hire price will be due if the hirer cancels their order.  The hirer accepts that CCL will invoice the full balance of the hire contract if it has not already been issued and that the hirer will pay the invoice 30 days prior to the original hire start date.

7. Cancellation by CCL

7.1 The hirer accepts that, if there are unforeseen circumstances beyond the control of CCL, that CCL reserves the right to cancel the hire period and refund the monies paid by the hirer in full within 48 hours of the date on which we advise the hirer (by email) of the need to cancel their booking.

7.2  The hirer accepts that CCL will not pay any additional compensation for cancellations other than refunding the monies already paid by the hirer.

8. Hire equipment substitution and hire period technical failure

8.1  The hirer accepts that, in exceptional circumstances, CCL may need to substitute the ordered hire product or associated materials such as props, accessories, lighting and other delivered items, for technical reasons or failures beyond our control.  

8.2  In the event that CCL need to invoke clause 8.1, no refund or partial refund of monies paid by the hirer will be due, unless substitution is not possible and we need to withdraw part of the order completely (such as an entire props package).

8.3  The hirer accepts that the highly technical nature of the hired equipment can, in rare instances, result in technical failure.  In the event that a technical failure occurs and prevents use of the hired equipment for a period that equates to more than 20% of the hire period (e.g. 24 minutes in a 2 hour booked period or 36 minutes in a 3 hours booked period, etc.) CCL will continue to be present at the venue for a period of time that is the same as the lost time if the technical failure can be overcome.  If the technical failure cannot be resolved, CCL will refund the hirer an amount equivalent to the percentage of time that the equipment was unavailable (e.g. if technical failure leads to 30 minutes of downtime and inability to use the equipment in a 2 hour booking, CCL will refund the client 25% of the total amount period, due to 30 minutes representing 25% of the 2 hour hire period).

9. Limitation of services

9.1 Your contract with CCL is for the hire of our products, delivery, construction, supervision and hosting by our staff.

9.2 CCL will not engage in any further service provision other than those ordered.

9.3  CCL staff will refuse any requests by the hirer, hirer's proxy or guests to engage in any activities or provision of services other than those ordered.

10. Payments

10.1 CCL's accepted methods of payment are:

Major debit or credit card through the CCL website

Bank transfer by prior arrangement

10.2 CCL do not accept cash or cheques.

11. Electrical item safety

11.1 Electrical items are tested and professionally maintained by CCL. 

11.2 The hirer accepts that CCL host(s) will refuse any request to use any non-CCL provided equipment such as mobile phones or cameras.

12. Photography and video recording of CCL host(s)

12.1 The hirer accepts that CCL host(s) may appear in the background of photography or video materials.

12.2 The hirer accepts that CCL host(s) can refuse to appear in any other type of photography or video recording than that provided by our hired items, and that our host(s) can refuse any request to be photographed or included in video material beyond that necessary in the provision of their services.  CCL hosts(s) can accept invitations to features in photographs or videos at their own discretion but cannot be placed under any pressure to do so.

13. Venue charges

13.1 Some Venues levy a charge to suppliers for providing hired services or products at your event. If your venue attempts to charges us any type of fee the hirer will be responsible for settling the fee with the venue.  CCL will not agree to payment of any fee. 

13.2 If non-payment of any fees by the hirer results in CCL's inability to provide the service/hired equipment at the venue, the hirer is not entitled to any refund.

14. Booking postponement

14.1 CCL may accept booking postponements, under exceptional circumstances, at their discretion if a minimum notice period of 30 days is given in writing by email.

14.2 CCL reserve the right to refuse booking postponements without explanation.

14.3 In the event of exceptional circumstances, such as a repeat of the COVID-19 lockdown restrictions, where there is a nationwide limitation applied, we will issue a full refund of booking deposits if your event cannot take place.  This condition only applies under official UK government lockdown terms that affect your booking, not personal preferences.

14.4 If you are affected by a restriction applied by your venue under exceptional circumstances, such as a fire damaging the venue, or the venue being similarly unavailable, we will permit rearrangement of your order dates if the newly requested date can be accommodated by us.

15. Length of hire

15.1 Length of hire is stated in hours except for a "Full Day" hire when the period of hire is 8 hours.

15.2 Length of hire is based on the end of the hire period ending by 23:00 hours on the day of hire at latest. Hire periods can only be extended beyond this by prior agreement and with a written quotation. Please note we will charge an additional fee that will be included in the quotation for any hire length that extends beyond 23:00 hours on the day of hire. We will also charge an additional fee for any length of hire where the end time extends to the next day, if we agree to provide hire for this period.

16. Complaints

16.1 Complaints, of any nature, relating to our provision of hired items, must be emailed to hello@crazecentral.co.uk and be received within 48 hours of the end time of your hire period. Your email must clearly state:

Your name and address

Your order number

A full and detailed reason for your complaint

Photographic evidence supporting your complaint (if possible)
